Washington’s Schedule I statute, RCW 69.50.204, lists psilocybin and psilocyn as controlled hallucinogenic substances. Federal rule 21 CFR 1308.11 also lists both in Schedule I. Seattle’s Resolution 32021 declared that the investigation, arrest and prosecution of people for entheogen-related activities should be among the city’s lowest law enforcement priorities.
Washington lists psilocybin and psilocyn among the hallucinogenic substances in Schedule I of its controlled substances statute[1]. The state legislature has also set up a psilocybin therapy services pilot program run by the University of Washington[4]. At the local level, the Seattle City Council and the King County Council have each passed measures on how entheogens rank as law enforcement priorities[3][5].
Are magic mushrooms legal in Washington?
Section 69.50.204 of the Revised Code of Washington (RCW) sets out Schedule I, and its list of hallucinogenic substances includes psilocybin at item (28) and psilocyn at item (29)[1]. That subsection covers “any material, compound, mixture, or preparation which contains any quantity” of the listed substances, including their salts and isomers[1]. The Schedule I list applies “unless specifically excepted by state or federal law or regulation or more specifically included in another schedule”[1].
At the federal level, 21 CFR 1308.11 lists psilocybin and psilocyn among the hallucinogenic substances in Schedule I, under code numbers 7437 and 7438[2]. The federal rule also covers any material, compound, mixture or preparation that contains any quantity of a listed hallucinogenic substance[2].

What else does current Washington state law say?
RCW 19.410.010 establishes the psilocybin therapy services pilot program within the University of Washington department of psychiatry and behavioral sciences, subject to amounts appropriated for it[4]. The statute required the department to implement the section no later than January 1, 2025[4].
The program must offer psilocybin therapy services through pathways approved by the federal Food and Drug Administration[4]. Its populations include first responders and veterans who are 21 or older and have posttraumatic stress disorder, mood disorders or substance use disorders[4].
The section comes from 2023 chapter 364, section 8, and a reviser’s note records that several other sections of that act were vetoed[4]. A version of the section effective June 30, 2027, uses the nursing title “advanced practice registered nurse” in place of “advanced registered nurse practitioner”[4].
Are mushrooms decriminalized in Seattle and King County?
Seattle
The Seattle City Council passed Resolution 32021, declaring that the investigation, arrest and prosecution of anyone engaging in entheogen-related activities should be among Seattle’s lowest law enforcement priorities[3]. The council’s announcement of the resolution is dated October 4, 2021[3].
According to the council, the Seattle Police Department (SPD) practice is neither to detain nor arrest individuals, nor to confiscate drugs from them, solely for suspected violations of RCW 69.50.4013 on possession[3]. The council also stated that this practice does not protect from arrest or prosecution people who cultivate entheogens, or people whose possession or cultivation becomes evident during an encounter started on another basis[3]. It added that current SPD practices regarding entheogens are not formally codified as departmental policy[3].
King County
On March 24, 2026, the King County Council approved a motion sponsored by Councilmember Teresa Mosqueda and co-sponsored by Councilmember Rod Dembowski[5]. The motion supports continued research and the existing practice of deprioritizing enforcement for entheogens in personal use quantities by adults[5].
It formalizes Council support for existing King County Sheriff’s Office and Prosecuting Attorney’s Office policies that focus on conduct that puts public safety at risk, rather than specific substances[5]. Mosqueda said the motion “did not require substantive changes to current practices”[5].
