No: RSMo 195.017 lists psilocybin and psilocyn as hallucinogenic substances, unless specifically excepted. Under RSMo 579.015, knowingly possessing a controlled substance, except as authorized, is a class D felony, apart from set amounts of marijuana or synthetic cannabinoids. Senate Bill 1767 (2026) would create limited exemptions for some veterans and first responders, and it was referred to committee.

Missouri’s statutes include RSMo 579.015, which sets out the offense of possession of a controlled substance and its penalty[2]. In 2026, the Missouri Senate also received SB 1767, a bill on alternative therapies and treatments that names psilocybin in its title[3].

Are magic mushrooms legal in Missouri?

RSMo 195.017 covers any material, compound, mixture or preparation that contains any quantity of the hallucinogenic substances it lists, unless specifically excepted[1]. Psilocybin and psilocyn appear on that list as items (ll) and (mm)[1]. At the federal level, 21 CFR 1308.11 also lists psilocybin and psilocyn among the hallucinogenic substances in Schedule I, unless specifically excepted or listed in another schedule[4].

What does Missouri’s possession law say about mushrooms?

RSMo 579.015 says a person commits the offense of possession of a controlled substance by knowingly possessing one, except as authorized by chapter 579 or chapter 195[2]. RSMo 579.015 makes possession of any controlled substance, other than thirty-five grams or less of marijuana or any synthetic cannabinoid, a class D felony[2]. The section was formerly numbered 195.202[2].

Has Missouri considered mushroom reform bills?

Under SB 1767 (2026), a veteran or first responder aged 21 or older with a condition listed in the act would not be subject to state or local criminal or civil penalties for acquiring, using, producing, possessing, transferring or administering psilocybin for their own therapeutic use[3]. That person would have to be enrolled in a study on psilocybin for those conditions and give the Department of Mental Health specified information[3]. The bill would also require a facilitator to be present when psilocybin is administered[3].

A separate provision would direct the Department of Mental Health, working with a Missouri university hospital or contract research organizations, to study alternative medicine and therapies, including psilocybin, for veterans and first responders[3]. The bill would also remove the current exclusion of Schedule I controlled substances from Missouri’s law on investigational drugs, and widen that law from terminal illnesses to life-threatening or severely debilitating conditions[3].

The Missouri Senate lists the bill’s current status as second read and referred to the Emerging Issues and Professional Registration Committee[3]. The bill summary calls SB 1767 identical to SB 1682 (2026) and similar to earlier bills, including SCS/SB 90 (2025), SCS/SB 768 (2024), HCS/HB 1830 (2024), HB 1154 (2023) and SB 614 (2023)[3].
